Distance Contract
A distance contract is an agreement between a consumer (a natural person) and a seller or service provider regarding the purchase of goods or the receipt of a service, concluded remotely. This means that the parties do not physically meet in one place to complete the transaction, but instead use means of distance communication.
Main characteristics of a distance contract:
Method of communication: The contract is concluded using the Internet (online stores), email, or telephone.
Parties: The contract is concluded between a trader (merchant) and a consumer.
Offer: The trader organizes the sale of goods or services remotely.
Common examples of distance contracts:
Ordering goods from an online store (e-shop).
Purchasing goods by telephone or through a catalogue.
Right of Withdrawal
The Cabinet of Ministers Regulations of the Republic of Latvia on distance contracts provide that the customer has the right to withdraw from the contract within 14 calendar days and return the goods to the seller.
However, since Section 12 of the Consumer Rights Protection Law states that “the consumer is responsible for maintaining the quality and safety of the goods during the period for exercising the right of withdrawal,” SIA “Vidzemes Mēbeļu Fabrika” reserves the right to refuse the buyer’s use of the right of withdrawal or to withhold a compensation fee in cases where the goods are not returned in their original packaging, the goods have been used, the packaging of the goods is significantly damaged, the product seals have been damaged, the protective film has been removed, or signs of careless use are visible, such as scratches and similar defects.
In order for the goods to be eligible for return, they must be in the same condition as when you received them: unopened or unused, with labels, and in their original packaging. Assembled furniture or furniture showing signs of assembly cannot be returned. Used goods cannot be returned.
In cases where it is possible to inspect the goods only by tearing or otherwise damaging the original packaging of the goods, for example, film packaging for washing machines, damage to the packaging shall not be used as grounds for refusing the exercise of the right of withdrawal. In such a case, in order to exercise the right of withdrawal, the buyer is obliged to keep the packaging and return it together with the goods, as the product serial number is indicated on the packaging. To ensure that the exercise of the right of withdrawal proceeds as quickly as possible, we kindly ask you to open the packaging of such goods as carefully as possible.
During the first 14 days from the moment of receiving the goods, the consumer has the right to return the goods in their original packaging and without signs of assembly, without giving any reason, except in cases where the goods are personalized. A personalized product is a product that is manufactured in a fabric, colour, or configuration according to the Client’s individual choice.
In accordance with Section 12, Paragraph Nine of the Consumer Rights Protection Law, the costs of transporting the goods back to the trader shall be borne by the consumer. The money for the returned goods shall be refunded within 14 calendar days after the day the goods are accepted at the supplier’s warehouse.
Return of Goods
What should you do if you wish to return or withdraw from the purchased goods?
If you have purchased goods from the online store www.abcmebeles.lv but wish to exercise your right to unilaterally withdraw from the distance contract and return the goods within 14 calendar days, you must:
- Contact the employees of the www.latsofa.lv online store by calling +371 20234430 and inform them of your decision, providing the following information:
- Your name and surname;
- Name of the product;
- Date of receipt of the product;
- Document confirming the purchase, such as the invoice number and date.
- After you have informed us of your wish to withdraw from the purchased goods, you must send an application written in free form to our company email address.
- The goods that you wish to return must be delivered to the warehouse of SIA “Vidzemes Mēbeļu Fabrika” at Ķekava Municipality, “Pamati”. However, the return date and time must be agreed in advance with the employees of the www.abcmebeles.lv online store.
- If you are unable to return the goods yourself, you may use the transport services of SIA “Vidzemes Mēbeļu Fabrika”. In this case, however, the goods will be collected from you according to the delivery schedule and delivery costs of SIA “Vidzemes Mēbeļu Fabrika”.
- The refund will be made only after the goods have been returned to the ownership of SIA “Vidzemes Mēbeļu Fabrika”.
- The refund will be made using the same payment method that the customer used at the time of concluding the transaction.
Assembled furniture is not exchanged and is not accepted back!
The right of withdrawal is valid in cases where the Buyer/Consumer acts in accordance with the following conditions:
- the returned goods are in their original packaging;
- the returned goods have no damage caused by the Buyer/Consumer;
- the returned goods are unused and their saleable appearance has been preserved, including undamaged labels, unremoved protective films, etc.;
- the returned goods are in the same complete set as received by the Buyer/Consumer, including user manuals;
- when returning the goods, the Buyer/Consumer presents the original purchase document — invoice/delivery note.
If the goods are not fully complete, are damaged, untidy, or not properly packaged, the Seller has the right not to accept the goods, as well as not to refund the money paid by the Buyer for the goods, or to accept the goods by assigning them a reduced value.
